According to Article 6 of Law No. 6698, titled ’Conditions for Processing of Special Categories of Personal Data," personal data pertaining to individuals' race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, clothing and appearance, association, foundation, or union membership, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data, are considered special categories of personal data. As a general rule, processing special categories of personal data is prohibited without the explicit consent of the data subject. However, special categories of personal data other than health and sexual life, as specified above, may be processed without the explicit consent of the data subject in cases stipulated by law. Personal data relating to health and sexual life may be processed without the explicit consent of the data subject solely for the purposes of public health protection, preventive medicine, medical diagnosis, treatment, and care services, and for the planning and management of health services and their financing by persons under an obligation of professional secrecy or by authorized institutions and organizations.
